Welcome to VoyageAway. These Terms of Use (“Terms”) govern your access to and use of the VoyageAway platform, including our website, mobile applications, and all related services (collectively, the “Service”), operated by VoyageAway (“we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Eligibility
You must be at least 16 years of age to use VoyageAway. By creating an account, you represent and warrant that you meet this age requirement and that the information you provide is accurate, complete, and current. If you are between 16 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account Registration and Security
To access certain features of the Service, you must create an account. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@voyageaway.com if you suspect unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms or if your account has been compromised.
3. Description of the Service
VoyageAway is an adventure travel discovery platform that connects users with wildlife experiences, conservation efforts, and a global community of adventurers. The Service includes adventure and activity discovery, wildlife sighting logging and tracking, user-generated content creation (reviews, tips, photos, forum posts), personal collections and saved adventures, community features, conservation impact tracking, and subscription-based premium features.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Service.
4. Subscriptions and Payments
4.1 Free and Paid Tiers
VoyageAway offers a free tier (“Explorer”) with limited features, and paid subscription tiers (“Adventurer” at $4.99/month, “Guardian” at $9.99/month, and “Champion” at $19.99/month) with additional features. Feature availability for each tier is described on our Pricing page and may change from time to time.
4.2 Billing and Renewal
Paid subscriptions are billed on a recurring monthly basis through Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on file for the applicable subscription fee at the beginning of each billing cycle. Subscriptions automatically renew unless you cancel before the end of the current billing period.
4.3 Cancellation
You may cancel your subscription at any time through your account settings or through the Stripe customer portal. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date. We do not provide refunds for partial billing periods unless required by applicable law.
4.4 Price Changes
We may change subscription prices from time to time. If we increase prices, we will provide at least 30 days’ advance notice via email or through the Service. Continued use of a paid subscription after a price change takes effect constitutes your acceptance of the new price.
4.5 Conservation Fund Allocation
A portion of each paid subscription is directed toward conservation efforts: 5% for the Adventurer tier, 15% for the Guardian tier, and 25% for the Champion tier. VoyageAway selects conservation partners and allocates funds at its discretion. We publish periodic reports on how conservation funds are distributed. Conservation fund allocation percentages may change; any changes will be communicated to subscribers in advance. Conservation fund allocation is a commitment by VoyageAway and does not constitute a charitable donation by you for tax purposes unless separately documented.
5. User-Generated Content
5.1 Your Content
You retain ownership of the content you create and post on VoyageAway, including text, photographs, reviews, tips, wildlife sighting reports, and forum posts (“User Content”). By posting User Content on the Service, you grant VoyageAway a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and promoting the Service.
This license continues even if you stop using the Service, but only for User Content that has been shared publicly or with other users. If you delete User Content that has not been shared, we will make commercially reasonable efforts to remove it from our systems, subject to technical limitations, backup retention, and any legal obligations.
5.2 Wildlife Sighting Data
Wildlife sighting data you submit (species, location, date, photos, and notes) may be aggregated and anonymized and shared with conservation partners and the scientific community to support wildlife research and conservation efforts. This is a core part of VoyageAway’s mission. By submitting wildlife sightings, you consent to this use of your sighting data. Individual sightings will be attributed to your username unless you choose to submit them anonymously.
5.3 Content Standards
You agree that your User Content will not:
- Be false, misleading, or intentionally inaccurate (especially regarding wildlife identifications, location information, or conservation claims)
- Infringe on the intellectual property rights of any third party
- Contain hateful, threatening, defamatory, or harassing material
- Promote illegal activities or harmful behavior toward wildlife, ecosystems, or protected areas
- Disclose precise locations of endangered species nesting sites, dens, or other sensitive wildlife areas that could facilitate poaching or disturbance
- Contain spam, commercial solicitations, or unauthorized advertising
- Include malicious code, viruses, or any technology that could harm the Service or its users
- Violate any applicable law, regulation, or these Terms
5.4 Content Moderation
We reserve the right to review, edit, or remove any User Content that violates these Terms or that we deem harmful, inappropriate, or inaccurate, at our sole discretion and without notice. We are not obligated to monitor all User Content, and we do not endorse or guarantee the accuracy of any User Content.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any part of the Service, other users’ accounts, or our systems
- Use automated scripts, bots, scrapers, or other automated tools to access or collect data from the Service without our express written permission
- Circumvent, disable, or interfere with security features of the Service
- Use the Service to harvest or collect email addresses or other personal information of other users
- Use wildlife location data obtained from the Service to engage in poaching, wildlife trafficking, or any activities harmful to wildlife or protected areas
- Resell, sublicense, or commercially exploit any part of the Service without our prior written consent
7. Intellectual Property
The Service, including its design, code, graphics, logos, icons, layout, and the selection and arrangement of content (excluding User Content), is the property of VoyageAway and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of any software used in the Service.
“VoyageAway” and our logos are trademarks of VoyageAway. You may not use our trademarks without our prior written permission.
8. Third-Party Services and Links
The Service may contain links to third-party websites, services, or content, including conservation organization websites, tour operator listings, and partner platforms. We do not control and are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is at your own risk and subject to the terms and policies of those services.
References to conservation organizations, tour operators, or other third parties on VoyageAway do not constitute endorsement. We encourage you to do your own research before making travel or booking decisions based on information found on the Service.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that any information on the Service (including wildlife identifications, trail conditions, safety information, or conservation data) is accurate, reliable, or complete, or that defects will be corrected.
Adventure and Safety Disclaimer: VoyageAway provides information about adventure activities, wildlife encounters, and outdoor experiences for informational purposes only. Adventure travel involves inherent risks, including physical injury, illness, and death. You are solely responsible for assessing and managing the risks associated with any activity you undertake. We strongly recommend consulting with qualified professionals, local guides, and relevant authorities before engaging in adventure activities. Information about trail conditions, wildlife behavior, weather, and safety should always be independently verified.
Wildlife Information Disclaimer: Wildlife identification, behavior descriptions, and conservation status information on VoyageAway are provided for educational and informational purposes. While we strive for accuracy and partner with conservation organizations, we cannot guarantee the accuracy of all wildlife data, particularly user-generated sighting reports. Do not rely solely on VoyageAway for wildlife identification in safety-critical situations.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOYAGEAWAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO VOYAGEAWAY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
We are not liable for any harm, injury, or loss arising from your participation in adventure activities, wildlife encounters, or conservation volunteer opportunities discovered through the Service.
11. Indemnification
You agree to indemnify, defend, and hold harmless VoyageAway and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of a third party.
12. Dispute Resolution
Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of laws principles.
Informal Resolution: Before filing any formal legal claim, you agree to contact us at legal@voyageaway.com and attempt to resolve the dispute informally for at least 30 days.
Arbitration: If we cannot resolve the dispute informally, any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Colorado. You agree to waive your right to a jury trial and to participate in class action lawsuits or class-wide arbitration.
Exceptions: Either party may seek injunctive or equitable relief in a court of competent jurisdiction for claims relating to intellectual property infringement or unauthorized access to the Service.
13. Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms.
Upon termination, your right to use the Service ceases immediately. If you have an active paid subscription, cancellation and refund terms in Section 4.3 apply. Sections of these Terms that by their nature should survive termination will survive, including Sections 5 (User-Generated Content), 7 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 12 (Dispute Resolution).
14. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and VoyageAway regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
Force Majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, acts of government, pandemics, or internet outages.
15. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, updating the “Last updated” date, and, where appropriate, sending you a notification via email or through the Service. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes.
